The people that are harmed in an auto accident involve more than just the occupants of the cars involved. The parents of a minor child or an adult child who is dependent on his parents for support shall have a cause of action for the loss of consortium of the child who has been seriously injured against any person who is legally responsible for causing such injury. The injured child must be dependent on his or her parent for support. At the very least the child’s dependence must be a financial dependence on his or her parents, either prior to the accident or after the accident or both.

There are no laws that precisely determine the monetary value of a loss of companionship on consortium claims. Spousal loss of consortium claims, a child’s loss of consortium claims due to the injuries of a parent or a parent’s loss of consortium due to the injuries suffered by a child are all claims involving non-economic damages. The value of these claims is to be decided by a jury or a Judge. The loss to be valued is the loss of the enjoyment of life, and the loss of that person’s companionship and support.

There is no exact formula to calculate the valuation of these claims.
