What is the aggravated form of assault & its Punishment?

Section 351 of Indian Penal Code states that if a person makes a gesture or makes preparations with intention or knowledge that the gesture or preparation will make the person realise that the accused is using criminal force to him then the accused committed assault. Words can also amount to assault provided that it apprehends the gesture and preparation amounts to assault. 

 

Aggravated form of assault –

Section 353 of Indian Penal Code

 

Section 353 of Indian Penal Code talks about assault to deter the public servants. It states that if a person deters or prevents public servants from executing his legal duty or having intention to do the same. Then he shall be punishable under the aforementioned section. 

Punishment– imprisonment for a term which may extend to 2 years or fine or both

 

Section 354 of Indian Penal Code

 

Section 354 of Indian Penal Code states that if a person assaults any woman with intention to outrage modesty of woman or knowing that his act will outrage the modesty of the woman then he shall be punished under this section. 

Punishment – imprisonment for a term not less than one year and may extend to 5 years along with fine. 

 

Section 355 of Indian Penal Code

 

Section 355 of Indian Penal Code talks about assault with intention to dishonour person except in case of sudden and grave provocation. The punishment under this section is imprisonment for a term which may extend to 2 years or fine or both. 

 

Section 356 of Indian Penal Code

 

Section 356 of Indian Penal Code talks about assault in an attempt to commit cognizable offence like theft of property. Punishment for the offence under this section is imprisonment for a term which may extend to two years or fine or both. 

 

Section 357 of Indian Penal Code

 

Section 357 of Indian Penal Code states that if a person assaults another while attempting wrongful confinement then he shall be punishable with imprisonment which may extend to 1 years or fine upto 1,000 rupees or both.
