NaLA Wins Court Victory Affirming that States Are Preempted from Setting Rates for Wireless Lifeline Services

WASHINGTON, May 6, 2021 /PRNewswire-PRWeb/ — Yesterday, the Northern District of California issued a decision in National Lifeline Association vs. the Commissioners of the California Public Utilities Commission, in their official capacity (Case No. 3:30-cv-08312-MCC). David Dorwart, Chairman of the National Lifeline Association praised the decision stating that “NaLA is pleased that the federal court acted decisively in granting our motion to strike down the California Public Utilities Commission rule that set rates for wireless Lifeline providers in violation of Section 332 of the Communications Act.” Dorwart added “We share a common goal with the CPUC in working to ensure that low-income Californians have access to affordable voice and broadband communications through the state and federal Lifeline programs.
